Terms of Service

1. Welcome

Welcome to DiecastVerified.com (the “Site”). The Site exists to make the work of the diecast collector community easier to access. The Site and the web services that power it are wholly owned and operated by ClubTuned (“ClubTuned,” “we,” “us,” or “our”).

By accessing or using the Site, submitting a verification request, creating an account, or otherwise interacting with the services, you agree to these Terms of Service (the “Terms”). If you do not agree, please do not use the Site.

2. The Service

The Site provides a public lookup of collectors who have been endorsed by other verified members of the community. The Site is a reference tool. It is not a marketplace, escrow service, payment processor, rating system, dispute-resolution service, or guarantor of any transaction between users. Listings, profiles, and verification status are provided on an “as is” and “as available” basis.

3. Eligibility and User Conduct

You must be at least 18 years old, or the age of majority in your jurisdiction, to submit a verification request or create an account. You agree to provide accurate information, to keep that information current, and to use the Site only for lawful purposes. You agree not to scrape, harvest, resell, or redistribute data from the Site without our prior written permission, and not to use the Site to harass, defame, or harm any other person.

4. Submissions, License, and Permitted Uses of Data

When you submit information to the Site — including your name, location, contact details, Facebook profile URL, and any other information you choose to provide — you represent that you have the right to submit that information, and you grant ClubTuned a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works of, display, distribute, and otherwise use that information in connection with operating, improving, marketing, and commercializing the Site and ClubTuned’s broader products and services.

Without limiting the foregoing, you specifically acknowledge and agree that use of this website grants ClubTuned permission to use all submitted and collected data for direct marketing, partnership, analytical, and third-party commercial offers, in each case subject to applicable law and the practices described in our Privacy Policy. You retain ownership of the underlying information you submit; this section is a license, not an assignment.

5. Verification Decisions

Verification status, including the decision to approve, decline, suspend, revoke, or annotate any entry, is made by the DiecastVerified team in their sole discretion based on community endorsements and review. ClubTuned does not independently warrant any individual’s trustworthiness, identity, or fitness to transact. You remain solely responsible for your own due diligence before engaging in any transaction.

6. Intellectual Property

The Site, including its software, design, text, graphics, and logos (other than third-party marks), is owned by ClubTuned and protected by intellectual-property laws. You may not copy, modify, distribute, sell, or lease any part of the Site without our prior written consent, except as expressly permitted by these Terms.

7. Third-Party Services and Links

The Site may link to third-party sites, including Facebook profiles. ClubTuned does not control and is not responsible for any third-party content, products, or services.

8. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CLUBTUNED DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CLUBTUNED, ITS AFFILIATES, OR ITS PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF CLUBTUNED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CLUBTUNED’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless ClubTuned, its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your submissions, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections of these Terms that by their nature should survive termination (including the license you grant, disclaimers, limitations of liability, and indemnification) will survive.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. You and ClubTuned agree that any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in St. Clair County, Illinois, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
